Contextual AI Usage Policy

This Usage Policy (“Usage Policy”) of Contextual AI, Inc. (“Contextual” or “we”) is designed to ensure safe usage of our products and services (collectively, “Services”) and applies to anyone who uses our Services. If you do not agree to this Usage Policy you should not use our Services.  Using our Services constitutes your acceptance of this Usage Policy.    

Our Services enable you to upload, transmit, store and receive content (e.g. prompts and outputs) (collectively “Customer Data”) and build, deploy and make available to third parties applications that leverage our Services and infrastructure (“Customer Applications”).   This Usage Policy applies to our Services as well as to Customer Data and Customer Applications.

Contextual reserves the right to make all interpretations and decisions regarding this Usage Policy. If you violate this Usage Policy we may suspend your ability to access and use the Services and may result in termination of the agreement between you and COntextual under which you are granted rights to use the Services. As our Services and the technologies which underlie them evolve we may need to make changes to this Usage Policy to ensure that our offerings remain safe, are used responsibly and comply with applicable laws.

All users must adhere to the following requirements and restrictions with respect to the use of our Services, the content that they upload, transmit or store via our Services and the applications that they build using our Services:

  1. You must comply with all applicable laws when using our Services.  This includes local, state/provincial, national and international laws, rules, regulations and orders (collectively “Laws”) including, without limitation, those which address or pertain to personal and privacy rights, intellectual property rights, and illegal and regulated activities. It also includes all Laws pertaining to artificial intelligence, machine learning and similar technologies (collectively “AI Technologies”) such as, without limitation, the European Union’s Artificial Intelligence Act, Regulation (EU) 2024/1689 (“EU AI Act“).  As such, regardless of your location, without Contextual’s prior written approval, you are not permitted to use, deploy or make available our Services, Customer Data or Customer Applications in connection with or for the purpose of any use case, activity, subject matter or objective that is considered “high risk” under the EU AI Act, including, without limitation, those listed on Annex III of the EU AI Act. You are responsible to ensure your full compliance with the foregoing.
  2. Certain Laws require disclosures to end users that they are interacting with AI Technologies based on the use cases for which the AI Technologies are deployed. If your use requires such disclosures we require that you implement such notices prior to enabling any user access to the Services, Customer Data or Customer Applications and that you maintain such notices as required under such applicable Laws.
  3. Do not use our Services for malicious purposes or to cause injury or damage to people, places or things.  Without limitation, do not use the Services to compromise critical infrastructure, to impair or violate the security of any system, to defraud, scam, spam, mislead, bully, harass, defame, discriminate based on protected attributes, or to promote violence, hatred or the suffering of others.
  4. Do not misuse or abuse the Services or the systems that enable them. Without limiting any other restrictions in our commercial agreements, you must not seek to circumvent any restrictions or limitations that are part of the Services and you must not use the Services in an unauthorized manner (e.g. scraping of content or data to train another model).
